These Terms and Conditions govern the use of the Zero Dark Tactical website and purchases made through it. “Zero Dark Tactical”, “we”, “us” and “our” refer to [INSERT LEGAL BUSINESS NAME]. By using the website or submitting an order, you agree to these Terms, subject always to rights and protections that cannot lawfully be excluded.
1. Website use
You may use this website for lawful personal shopping, product research and communication with us. You may not misuse the website, interfere with its operation, introduce malicious code, attempt unauthorised access, scrape it at unreasonable volume, or use its content for unlawful or infringing purposes.
2. Customer eligibility
You must have legal capacity to enter into the transaction. If you are under the age at which you can contract independently, a parent or legal guardian must approve and complete the purchase. You are responsible for the accuracy of information supplied with your order.
3. Products and descriptions
We aim to describe each product accurately, including its main characteristics, materials, fit and care information where available. Minor manufacturing variations may occur. Product names, editorial copy and styling language do not amount to a guarantee beyond the express product description and rights provided by law.
4. Product images and colours
We aim to present colours and details accurately, but screens, lighting and photography can affect appearance. A reasonable colour variation does not necessarily mean that a product is defective. This does not limit your rights where a product is materially different from its description or sample.
5. Pricing
Prices are shown in the currency displayed on the website. The full amount payable, including available delivery charges and applicable taxes, will be shown before you submit the order. We may correct an obvious pricing error before accepting an order. If payment has already been taken for an order we cannot accept because of an error, we will refund it.
6. Orders
Placing an order is an offer to purchase the selected products. You must review the order, delivery details and total before submitting it. An automated acknowledgement confirms receipt of the order but does not necessarily constitute acceptance.
7. Payment
Payment is processed through Shopify and the payment providers available at checkout. You confirm that you are authorised to use the chosen payment method. We do not require customers to send full card details by email or ordinary message.
8. Order acceptance
An order is accepted when we expressly confirm acceptance or begin fulfilling it, whichever occurs first. We may decline or cancel an order for a lawful reason, including unavailable stock, suspected fraud, an obvious error, payment failure, delivery limitations or a breach of these Terms. If we cancel after receiving payment, we will refund the amount due.
9. Product availability
Products remain subject to availability. Adding an item to a cart does not reserve it. If an item becomes unavailable after purchase, we will contact you and provide an appropriate refund or agreed alternative.
10. Limited releases
Some ZDT products may be released in limited quantities. We may set reasonable purchase limits to support fair access and may cancel quantities that exceed a stated limit. Restocks are not guaranteed.
11. Shipping and delivery
Delivery methods, available charges and estimates are described at checkout and on our Shipping & Delivery page. Please provide accurate delivery information. Estimated dates are not guaranteed unless expressly stated. Risk and responsibility transfer in accordance with applicable law.
12. Returns and refunds
Our Returns & Refunds policy forms part of these Terms. It supplements and does not replace any right or remedy under the Consumer Protection Act, the Electronic Communications and Transactions Act or other applicable legislation.
13. Incorrect or defective products
Contact us promptly if an item is incorrect, damaged, unsafe or defective. We may request reasonable information or photographs and may need to inspect the item. Available remedies will be determined in accordance with applicable law. We do not exclude or restrict a warranty, remedy or consumer right that cannot lawfully be excluded.
14. Promotions and discount codes
Promotions may have specific eligibility dates, stock limits and other conditions disclosed with the offer. Unless stated otherwise, discount codes cannot be combined, exchanged for cash or applied retrospectively. We may refuse use that is fraudulent, unauthorised or contrary to disclosed conditions.
15. Intellectual property
The website and its content—including text, photographs, graphics, layout, product designs and software—are owned by or licensed to us and protected by applicable intellectual-property law. You may use the site for personal shopping only. No content may be reproduced, adapted, distributed or commercially exploited without written permission, except where law permits.
16. Zero Dark Tactical branding
ZERO DARK TACTICAL, ZDT, BUILT FOR THE DARK., the circular ZDT mark, logos, garment graphics, designs and artwork are proprietary brand assets. Nothing on the website grants a licence to manufacture, reproduce, sell or use them as branding without written authorisation.
17. Privacy
Personal information is handled under our Shopify-hosted Privacy Policy and applicable data-protection law, including the Protection of Personal Information Act where applicable. Review the policy before submitting personal information.
18. Third-party services
The store relies on third parties such as Shopify, payment providers, couriers and analytics or communication services. Their services may be governed by additional terms and privacy practices. We remain responsible to the extent required by applicable law but are not responsible for an independent third party’s conduct beyond that extent.
19. Limitation of liability
To the fullest extent permitted by law, neither party is liable for indirect or consequential loss that was not reasonably foreseeable. We do not limit liability for fraud, gross negligence, personal injury caused by unlawful conduct, breach of a non-excludable statutory duty, or any other liability or consumer right that cannot legally be limited or excluded. Use apparel only for its intended purpose; ordinary lifestyle apparel is not protective equipment unless expressly certified and described as such.
20. Force majeure
We are not responsible for delay or failure caused by circumstances beyond our reasonable control, including severe weather, natural disaster, epidemic, civil disturbance, labour disruption, network or utility failure, government action, transport interruption or supplier failure. We will take reasonable steps to reduce the effect and will not rely on this clause to remove rights that cannot lawfully be excluded.
21. Changes to these Terms
We may update these Terms for legal, operational or business reasons. The version displayed when an order is placed applies to that order unless a change is required by law or agreed with you. Continued website use after an update means the updated terms apply to future use.
22. Governing law
These Terms are governed by the laws of the Republic of South Africa. Nothing in this clause prevents a consumer from using a court, tribunal, ombud, commission or other forum available under applicable law.
23. Contact information
Questions about these Terms may be submitted through our Contact page.
